1. Acceptance of Terms

By accessing or using the Eterne AI service (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Eterne AI is an emotional support and memorial platform — it is not a substitute for professional grief counseling or medical advice.

2. Description of Service

Eterne AI provides a digital platform that allows users to create and interact with AI-generated representations of deceased loved ones. The platform generates text conversations, voice messages, and animated video tributes based on user-provided photographs, audio recordings, and written memories. These are synthetic recreations — they are not sentient beings, and no claim is made that the deceased is conscious or aware through the Service.

3. User Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are of legal age and that all information you provide is accurate and truthful.

4. User Content

You retain all ownership rights to the photographs, audio recordings, and written memories you upload ("Your Content"). You grant Eterne AI a limited license to process, store, transmit, and display Your Content solely for the purpose of providing and improving the Service.

You represent and warrant that:

• You own or have obtained all necessary rights and consents to use Your Content
• You have obtained consent from the legal next-of-kin or estate of any deceased person whose likeness or voice you upload, or you are the legal next-of-kin yourself
• Your Content does not violate any applicable law or third-party rights

5. Subscriptions and Billing

Eterne AI offers subscription plans with recurring billing. By subscribing, you authorize us (or our payment processor, Paddle) to charge your chosen payment method on the agreed billing frequency (monthly or yearly).

• Your subscription renews automatically unless canceled before the next billing date
• You may cancel at any time through your account settings or by contacting support
• Cancellation takes effect at the end of the current billing period — you keep access until then
• Refunds are handled in accordance with Paddle's refund policy and applicable law
• Prices are in US dollars and exclude any applicable taxes

6. Credits and Usage

Subscription plans grant a monthly allocation of credits. Credits are consumed per action (text conversation, voice message, or video generation). Unused credits do not roll over. Credits are not redeemable for cash. We reserve the right to adjust credit costs with reasonable notice.

7. Acceptable Use

You agree not to:

• Use the Service to create representations of living persons without their explicit consent — this includes impersonation, face-swapping, or unauthorized use of anyone's likeness or voice
• Use the Service to create representations of celebrities, public figures, or any individual who is not a deceased family member of yours
• Upload content that is unlawful, obscene, defamatory, or infringes on any third-party rights
• Attempt to reverse-engineer, scrape, or disrupt the Service
• Use the Service for any commercial purpose beyond personal memorial use
• Share your account credentials or allow unauthorized access

Violation of these provisions will result in immediate account termination without refund.

8. Data Retention and Deletion

Your uploaded source materials (photographs, audio recordings) are automatically deleted 7 days after your persona is completed, unless a longer retention period is required by law. Generated content (text conversations, voice messages, videos) is retained for the duration of your active subscription and deleted within 30 days of account cancellation. Deleted data cannot be recovered.

9. Limitation of Liability

Eterne AI is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Eterne AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. The total liability of Eterne AI for any claim arising from the Service is limited to the amount you have paid in the 12 months preceding the claim.

10. Emotional Well-being

Grief affects everyone differently. If you experience distress while using the Service, we encourage you to pause and seek support from a mental health professional or grief counselor. We also recommend the following resources:

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may terminate your account at any time. Upon termination, all generated content will be deleted within 30 days.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
